Eternal Acts Production - Client Consent & Agreement Form

1. Consent & Agreement for Photography, Videography, and Graphic Services

By checking the box below, the Client affirms their full and informed consent to engage Eternal Acts Production (“Company”) for professional media services, including but not limited to photography, videography, and graphic design. The Client acknowledges that they have requested services that may include on-location shoots, studio sessions, editing, post-production enhancements, and delivery in various formats as agreed upon in advance. The Client understands that all production efforts will be conducted with the utmost professionalism, discretion, and in alignment with the specifications communicated before the commencement of services.The Client acknowledges and agrees that Eternal Acts Production retains creative discretion during production and post-production to maintain artistic integrity unless otherwise explicitly stated in writing before project initiation. The Client also consents to allow Eternal Acts Production the reasonable use of assistants, contractors, third-party collaborators, or vendors when necessary to execute high-quality services. The Client agrees that all expectations, visual references, and deadlines should be established clearly in writing prior to service delivery to avoid any miscommunications.The Client affirms that all individuals participating in media content (subjects, models, attendees) have been informed and have given their consent to be recorded or photographed unless noted otherwise in writing. Eternal Acts Production shall not be held liable for any claims resulting from unapproved individual participation. This consent is binding as of the date of checkbox approval on the digital form hosted through Eternal Acts Production’s official website.

2. Release of Liability & Insurance Coverage Disclaimer

By signing this agreement through the checkbox feature, the Client releases and holds harmless Eternal Acts Production, its owners, employees, agents, contractors, successors, and assigns from any and all claims, demands, causes of action, damages, or liabilities of any kind arising from or related to the services provided, including travel to and from the service location(s), use of equipment, interactions with talent or vendors, or conditions at any physical site involved.This release includes, without limitation, any personal injury, property damage, or equipment loss sustained before, during, or after production. The Client understands that while Eternal Acts Production carries general business liability coverage, it does not provide comprehensive insurance for every possible incident, particularly in high-risk or outdoor environments. If the Client wishes to obtain specific insurance coverage (e.g., venue coverage, talent accident insurance, property insurance), they are fully responsible for arranging and financing such policies.Eternal Acts Production is not responsible for any delays or disruptions resulting from acts of God, weather conditions, technical malfunctions, or uncontrollable circumstances. In such cases, rescheduling will be discussed, but refunds are not guaranteed unless otherwise negotiated in writing. By proceeding with this agreement, the Client accepts full responsibility for understanding their own insurance needs and releases the Company from any liability beyond the scope of its services and control.

3. Talent Use, Image Rights, and Creative Ownership

The Client grants Eternal Acts Production a non-exclusive, royalty-free, worldwide license to use, reproduce, display, publish, and distribute any media produced during the scope of the project for portfolio use, promotional material, and advertising unless the Client explicitly opts out in writing before the commencement of services. This includes, but is not limited to, the use of images and video clips on Eternal Acts Production’s website, social media platforms, showreels, promotional ads, and client testimonials.The Client affirms that any talent (models, speakers, performers, etc.) who will appear in the footage or photos have given full consent to be filmed, photographed, or recorded. Eternal Acts Production shall not be held liable for talent who later retract their consent unless the Company is notified in writing prior to the project start. All footage, audio, and images captured during the project remain the intellectual property of Eternal Acts Production, unless a written licensing agreement specifies otherwise.Any content transferred to the Client will be limited to usage within the agreed-upon scope. Commercial or broadcast distribution of the content outside of these terms requires separate licensing and may incur additional fees. Eternal Acts Production retains the right to protect its artistic and commercial interests and may take legal action if its content is used beyond the agreed scope without proper authorization.

4. Payment Terms, Installments, and Non-Refundable Deposits

The Client agrees to the full payment of the services rendered as outlined in the signed estimate, invoice, or booking summary. Eternal Acts Production requires a minimum non-refundable deposit of 30% to secure a booking date unless otherwise stated. No work shall begin until the deposit is received, and the remaining balance must be paid in full prior to the delivery of the final project unless a written payment plan is approved.If a payment plan is agreed upon, the Client must adhere strictly to installment deadlines. Failure to make timely payments may result in a pause of services, withholding of deliverables, or termination of the agreement without refund. In the case of chargebacks, failed transactions, or reversed payments, the Client will be held legally and financially responsible for all costs incurred, including collection fees and attorney’s fees.Eternal Acts Production does not issue refunds for completed work or deposits on canceled services. If a cancellation occurs before services begin, only amounts paid beyond the deposit may be eligible for partial refunds. Payment for optional add-ons (prints, additional edits, expedited delivery, etc.) must be made in advance unless otherwise negotiated. The Client acknowledges this policy and agrees not to dispute valid transactions once services commence.

5. Confidentiality & Non-Disclosure Agreement (NDA)

Both the Client and Eternal Acts Production agree to keep all proprietary information, production details, behind-the-scenes footage, scripts, concept materials, personal client information, or sensitive business matters confidential. This non-disclosure agreement (NDA) applies indefinitely and covers all communication, files, planning, and deliverables shared before, during, or after production.Eternal Acts Production will not share or sell any private content, information, or strategies provided by the Client without written consent. Similarly, the Client agrees not to disclose pricing models, templates, behind-the-scenes workflow, or internal documents belonging to Eternal Acts Production to third parties without explicit permission. This agreement safeguards trade secrets, creative concepts, and professional conduct on both sides.Violations of this NDA may result in legal consequences, including financial restitution and injunctions. The Client agrees to respect the intellectual property and business operations of Eternal Acts Production, and vice versa. If collaboration with outside vendors or freelancers is necessary, each will also be held to confidentiality as per this agreement.
